IMPORTANT!

After the issuance of  an original marriage license, it needs to be filed with any Register of Deeds Office (Can be to any Register of Deeds in the State of Wisconsin) AFTER the date of the wedding.

Prior to applying for a marriage license, you must have a wedding date and officiant scheduled.

WHERE DO I APPLY?
In person at the County Clerk's office located in the Lincoln County Service Center - Directions.

WHAT IS THE COST?
The price for a marriage license: $90.00 (non-refundable).

The price for a marriage license with waiver of the waiting period: $115.00 (non-refundable). 

WAITING PERIOD: 3 DAYS - The license is only valid for 60 days once it's issued. Payment can be made by check, cash, and debit or credit card.

REQUIREMENTS:

  • Both applicants MUST be present.
  • A valid photo identification for both applicants.
  • Certified birth certificates for both applicants. Hospital copies will not be accepted. If you do not have a certified copy, you may obtain one from the Register of Deeds. If you are a legal immigrant, you must show a green card, or if you have become a citizen of the United States, you must show your citizenship papers.  Foreign birth certificates must be translated into English.
  • Social Security Number for both applicants.
  • Copy of divorce/annulment (Findings & Facts, as well as the Marital Settlement Agreement), certified copy of divorce/annulment certificate, or death certificate from the previous marriage if applicable.
  • Proof of residency including name of municipality and county for the last 30 day for both applicants. If the address on the identification is not current, bring in an official document with your name and address (i.e. utility bill, lease, bank statement, paystub, etc.)
  • Date and location of ceremony including county and municipality (city, village or township).
  • Officiant name, address and phone number or email address. Couples are responsible for determining that the officiant they have chosen to solemnize the ceremony is compliant per Wisconsin Statutes 765.16
  • If you are under the age of 18, A consent form is required and must be signed by both parents or legal guardians.

Per Wisconsin Statutes 765.16, Once a marriage license has been issued by the County Clerk, the marriage may be validly solemnized and contracted in this state only after a marriage license has been issued therefor, and only by the mutual declarations of the two parties to be joined in marriage that they take each other as husband and wife, made before an authorized officiating person and in the presence of at least two competent adult witnesses, other than the officiating person.
