Variance Information

The Board of Adjustment hears and decides requests for permitted variations from the terms of the Land Services Ordinances as they will not be contrary to the public interest; where owing to special factors, a literal enforcement of the provisions of this chapter would result in practical difficulty or unnecessary hardship, so that the spirit of the zoning ordinance shall be observed, public safety and welfare secured, and substantial justice done; as provided for by Wisconsin Statutes and applicable case law.

What are the criteria for granting a variance? To qualify for a variance, an applicant has the burden of proof to demonstrate that all three criteria defined in state statutes and outlined below are met.

  • Unnecessary hardship
  • Unique property limitations
  • No harm to public interests
