Court Appointed Attorney
Agreement and Order Regarding Counsel
If the judge has approved your Petition for Appointment of Counsel, it is your responsibility to find an attorney to represent you and then have that attorney complete this form and return it to the court for approval. A list of local attorneys who have indicated that they will accept cases under court appointments is included in this section.
List of Local Attorneys
This is a list, although not inclusive, of local attorneys who have indicated that they will accept cases through court appointments. While you are free to select an attorney that may not appear on the list, you must be sure that they are willing to accept the reduced court appointed rate of $70 per hour before they can be appointed to represent you.
Petition for Court Appointed Attorney
If you are the parent of a child in a CHIPS or guardianship matter and do not qualify for representation by the State Public Defender's Office, you can complete this form and file it with the court, requesting that an attorney be appointed for you at county expense. In addition to this form, you will also need to complete the Agreement and Order Appointing Counsel form.

In addition to the fees set forth in the above Fee Schedule, Lincoln County requires the following fees:

All Form Packets obtained from the Register in Probate are $5.

A $200 deposit is required in any case requiring the appointment of a guardian ad litem unless waived by a formal order of the court.

Temporary Guardianship Guidelines

Volunteer Guardianship Questionnaire
The following form is to be completed by any person(s) interested in serving the Lincoln County Court System as a Volunteer Guardian. Volunteer Guardians play an important role in the court system and provide necessary assistance and support to incapacitated individuals who do not have a relative or other suitable adult willing or able to do so.

If interested in being considered as a Volunteer Guardian, please complete the form and return it to the Register in Probate Office either in person or by U.S. Mail or e-mail.

Probate
Claim Against Estate
Use this form to file a claim against a pending estate. There is a statutory $3 filing fee that must accompany each claim filed.

The above is a checklist developed by the Register in Probate to assist personal representative's in keeping track of the documents they have filed and those that still need to be filed.

Non-Probate of Filed Will Affidavit
This form should accompany the original Last Will and Testament of any decedent whose estate does not require probate, but is being filed with the Register in Probate.
Order to Examine Safety Deposit Box
This form requires the signature of one of the Circuit Court Judges and must be certified by the Register in Probate. Upon providing a certified copy of the signed order to a bank official, you will be able to gain access to the safety deposit box of the decedent.
Personal Representative's Guide to Informal Probate
The Personal Representative's Guide to Informal Probate was developed by the Wisconsin Register in Probate Association (WRIPA) to assist non-represented individuals with the Informal Probate process. In it you will find definitions to common probate terms, answers to common probate questions, and instructions on how to complete a variety of probate forms. You can view the Guide online, print it, or obtain a copy from the Register in Probate Office for a fee of $5.
Petition and Order to Waive Closing Certificate
Lincoln County requires that a Closing Certificate for Fiduciaries be filed in every estate, unless waived. If the estate you are administering qualifies to have the Closing Certificate waived, you can complete this form and file it with the Register in Probate. If approved, you will not be required to obtain a Closing Certificate from the Wisconsin Department of Revenue. To determine if an estate qualifies for waiver of the Closing Certificate go to http://www.revenue.wi.gov/faqs/ise/estate.html.
